1. Acceptance of Terms

By accessing or using the website operated by Naughty Nemo Studio (“we,” “us,” or “our”) and placing any order through our site, you (“Customer” or “you”) agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our website or services.

2. Our Services

Naughty Nemo Studio offers custom embroidered and printed sweatshirts, T-shirts, hats, throw pillows and all kinds of apparel. Customers may:

  • Browse and purchase ready-made designs
  • Upload custom artwork to be embroidered or printed on garments
  • Select delivery options during checkout

3. Eligibility

You must be at least 18 years of age to place an order. By using our website, you represent that you meet this requirement. We currently deliver to the United States, Japan, Southeast Asia, Europe and other regions.

4. Custom Artwork Uploads — Intellectual Property

4.1 Customer Representations

When you upload artwork, images, logos, or any visual content (“Uploaded Content”) for custom embroidery or printing, you represent and warrant that:

  • You are the original creator of the Uploaded Content, or you hold all necessary rights, licenses, and permissions to use and reproduce it;
  • The Uploaded Content does not infringe upon any copyright, trademark, trade dress, right of publicity, or any other intellectual property or proprietary right of any third party;
  • The Uploaded Content does not contain defamatory, obscene, hateful, or otherwise unlawful material.

4.2 Our Rights to Use Uploaded Content

By uploading artwork and placing an order, you grant Naughty Nemo Studio a non-exclusive, royalty-free, worldwide license to:

  1. Reproduce and embroider or print your Uploaded Content solely for the purpose of fulfilling your order;
  2. Use photographs and videos of your completed order — including the Uploaded Content as embroidered or printed — in our marketing materials, social media posts, short videos, advertisements, and all promotional content. You waive any right to additional compensation for such use. If you do not wish your artwork or finished item to appear in our marketing materials, you must notify us in writing via naughtynemo@163.com  at the time of order placement.

4.3 Prohibited Content

You may not upload artwork that:

  • Contains hate symbols, white supremacist imagery, or content that promotes violence or discrimination against any individual or group;
  • Depicts explicit sexual content or nudity;
  • Infringes any third-party intellectual property rights (e.g., unauthorized use of brand logos, copyrighted characters, or trademarked imagery);
  • Violates any applicable local laws of your shipping destination. We reserve the right to refuse any order containing Prohibited Content at our sole discretion without refund if production has not yet begun.

4.4 File Requirements

For best embroidery and print results, uploaded files must meet the following minimum requirements: Accepted formats: PNG, JPG Minimum resolution: 300 DPI at intended print size Maximum file size: 50 MB We are not responsible for poor output quality resulting from low-resolution or improperly formatted files. We will contact you if a submitted file cannot be used.

4.5 Indemnification for Uploaded Content

You agree to indemnify, defend, and hold harmless Naughty Nemo Studio, its owners, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your Uploaded Content or your breach of the representations in Section 4.1.

5. Orders and Payment

All orders are subject to acceptance by us. We reserve the right to cancel any order and issue a full refund at our discretion.

6. Production and Shipping

Each item is made to order. Our standard production time is 7–14 business days from the date of order confirmation. Shipping times are in addition to production time. We are not responsible for delays caused by shipping carriers or circumstances beyond our control.

7. Returns and Refunds

Because every item is custom-made to your specifications, all sales are final. We do not accept returns or exchanges except as described below.

7.1 Acceptable Minor Embroidery Marks (Washable)

Due to the nature of commercial embroidery machinery, the following minor marks may occasionally appear on finished items and are considered normal, washable occurrences — not production defects:

  1. Isolated drops of machine oil, which are fully removable with a standard stain remover during regular machine washing;
  2. Light black marks from the pantograph (an internal embroidery machine component), which are similarly washable. If your item arrives with either of these marks, we treated the affected area with a professional stain-removal spray before shipment. Please be aware that complete removal of these marks requires machine washing by the customer. Washing instructions will be included with your order. These washable marks do not qualify for a return, replacement, or refund.

7.2 Non-Acceptable Defects — Replacement Guaranteed

Any physical damage caused by the embroidery machine that results in holes, tears, or punctures in the fabric is not acceptable and will never be shipped to a customer. Should such damage occur during production, we will replace the garment with an identical item at no additional cost to you. Your order will proceed on the standard production timeline.

7.3 Wrong Size or Color Shipped in Error

If the garment size or color you receive does not match what you ordered due to our fulfillment error, you are entitled to a full return or exchange at no additional cost. Please contact us within 7 days of delivery via naughtynemo@163.com with a photo of the item received and your original order details. We will arrange return shipping and send the correct item promptly.

7.4 Returns on Ready-Made (Non-Custom) Items

Items from our standard online store collection, sweatshirts with pre-designed prints or embroidery that are not made to individual customer specifications are eligible for return or exchange within 14 days of delivery, provided the item is unworn, unwashed, and in its original condition with all tags attached. To initiate a return, contact us via naughtynemo@163.com  Return shipping costs are the responsibility of the customer unless the return is due to our error.

7.5 Other Production Defects

For any other verified production defects (e.g., embroidery error on our part), please contact us within 7 days of delivery via naughtynemo@163.com with photos of the defect. We will offer a reprint or store credit at our discretion.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Naughty Nemo Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of our services, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid for the order giving rise to the claim.

9. Disclaimer of Warranties

Our services are provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Governing Law & Dispute Resolution

  1. Governing Law These Terms of Use shall be governed by and construed in accordance with the laws of the People’s Republic of China. Meanwhile, we shall fully comply with all mandatory local consumer protection and data privacy laws of your shipping destination, including CCPA, GDPR, and Japan’s Act on the Protection of Personal Information.
  2. Dispute Resolution Any dispute arising out of or related to these Terms or your order shall first be resolved through friendly negotiation. If negotiation fails, both parties irrevocably agree to submit the dispute to China International Economic and Trade Arbitration Commission (CIETAC) for online arbitration under its arbitration rules effective at the time of application. The place of arbitration shall be Guangzhou, China. The arbitral award shall be final and binding on both parties.
  3. Supplementary Note: Arbitral awards are enforceable in most countries worldwide under the New York Convention. If mandatory local laws require local jurisdiction for consumer disputes, you may file small consumer claims in your local region.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website after any changes constitutes your acceptance of the revised Terms.
